I love My Cousin Vinny. Most lawyers do. It is just a great movie that involves great lawyering. Everyone should watch this movie. But the question is: Is Vinny Gambini a good lawyer? We'll find out today.
The movies starts with two students driving through the South on their way to California. Once they arrive in Alabama, they stop at a local convenience store to pick up a few snacks. The store clerk is murdered just after they leave and, in a case of mistaken identity, they are fingered for the crime. Facing execution, the students do not have enough money for a lawyer, so they hire their cousin, Vincent Laguardia Gambini (Joe Pesci). After failing the bar 5 times, Vinny has been a lawyer for about six weeks and has to learn the process on the job. Vinny has to defend his clients and battle an uncompromising judge, some tough locals, and even his fiancée, Mona Lisa Vito (Marisa Tomei).

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

      if i were a lawyer i would refuse to wear a suit even if the judge banned me and i lost my job. the suit is the uniform of evil. you never see super villains who don't wear suits in this world. i would wear the clothes of the poor and homeless and losers because being rich and powerful and successful is evil. god loves the least amongst us. i would never portray that i am better than someone else by wearing the uniform of the elite. the meek shall inherit the earth and didn't jesus stand in solidarity with the least among us? isn't jesus considered the ultimate role model?

    You can swap the rear end from the Tempest to a Skylark. It's about as hard as changing a muffler. And just because a paint shade was available in a 63 Pontiac doesn't at all mean that it will be for a 64 Buick as well. This was back when GM was seriously into competition between the badges. The "expert" witness wasn't right about much.

    I have this question: If you are stopped by police and believe that you are under wrongful or disproportionate suspicion, are you able to (and if so, at what point) able to ask them what that suspicion is?

    While the judge was mostly pretty good, he overruled two major objections from Vinny, presumably due to his personal vendetta against him. Obviously appealable and makes him look bad. The better course would have been for the judge to delay the trial, and have time to get to the bottom of Vinny's lies.

    MCV was supposed to be part of a thematic trilogy. Not really a trilogy in the sense of continuous narrative but three separate stories with a similar theme. Another part of the trilogy was Trial and Error from 1997. Did you see that? Both a hilarious movie and perhaps Charlese Theron at her absolute hottest. Probably way underrated.

    Ao, when you were talking about Discovery, why did you say specifically "The Prosecution?" Was it just because of the contect of the movie? Because if the defence finds any evidence, they would have to turn that in to the Prosecution, if only the Prosecution had to follow this rule and not the Defense than that is already an unfair advantage.

    Objection: The judge overrules Vinny's objection about not having been informed about the expert witness with no explanation as to why it was overruled and there was no comment in the video about whether or not a judge would really do this, which I'd be interested in. Second objection: There was no mention of the conduct of the court appointed lawyer, which I also would have been interested in seeing (bolstering the strength of the prosecution's argument, for instance) Third objection: The lawyer for prosecution in this movie is allowed to choose the jury (or at least select whether they are of the right mindset) in one scene. Is this allowed? This feels like misconduct.

    One thing had always bothered me about this movie, and that is when Vincent objects to the prosecution calling their automotive expert. The judge tells Vinnie that he has made a coherent and logical argument, then overrules the objection and allows the witness. Why would he do that? CAN he do that? As clearly as the objection was stated, it seems like the judge allowing the witness would be a direct violation of procedure, putting a potential guilty verdict in doubt in case of an appeal.

    I love this movie, but Marisa Tomei has always bothered me. I know it's a movie and the good guys are supposed to win,but realistically, Marisa Tomei's testimony wasn't actually that good. Her "expert" testimony has one major flaw. She never examined the defendant's car. She can only testify about the car's factory settings. Without examining the car she has no idea about any possible modifications that could explain the same evidence.

    We actually watched "My Cousin Vinny" in my trial advocacy class in law school for examples of direct and cross examination. After having completed many evidentiary hearings since becoming licensed, this is still one of my favorite legal movies!

    Please do a vid about the movie Fracture w/ Anthony Hopkins and Ryan Gosling! It was a real good movie. However I did have an issue with the ending. How did such a calculating, manipulating mastermind come up with such a clever plan yet overlooked a very basic simple issue that even I, someone who’s got nothing to do with the law, called it as soon as they disconnected the life support. Wonder if the weird desire for American movies to have happy endings had anything to do with that sloppy finish. But rest of the movie seemed great. I’m just worried that it wasn’t realistic. So please review it and either confirm my positive impression or go ahead and disappoint me with cold hard facts... ;) Thanks! Romie

    That's not an example Elmo! That's an overhead transparency projector! The Elmo brand is best known for document cameras, a video camera on a fancy stand that feeds images of *opaque* documents to a projector. So things like photos can be projected without having to be developed as slides.

    I would have liked to hear your comments on Vinny's cross on the 3rd witness, the half blind woman. Most trial lawyers don't understand that a jury not only hears your argument, but also watches your "People Skills" when crossing a witness, who, in this case, was elderly a kindly soul and someone who; if you stepped outside of the standards of respect. Would have soured the whole walk back of the testimony to the jury and most likely would have been sanctioned by the court. Thus moving the momentum back to the prosecution. I think Joe Pesci handled the grand motherly witness in such a way, that it probably sealed the deal after her testimony. For that scene alone, "My Cousin Vinny" gets an A+ from me.

    I'm a trial attorney. Great film for entertainment, and not a class on courts. It's terrible for courtroom stuff. Peschi would be sanctioned by the Judge for lying and disrespect. Cross exam is "yes" or "no" Q&A. Not narratives. Also, compound questions are not allowed. Also, a lawyer wouldn't ask a question he doesn't know the answer to, or be argumentative, or ask questions like the 20 minute grits without establishing it takes 20 minutes to cook grits. Pictures would never be introduced like this. The jury would need to see each contemporaneous to the witness description. Prosecution clearly violates the rules on civil procedure and notice of witnesses. The "Daubert" standard is pronounced "Dauber." I love Marisa Tomei but her testimony is absurd and not an "expert" testimony. I don't recall her "credentials," but an opposing counsel could easily get her to agree that a car could be modified with posi-traction and nullify her testimony.
